Terms and Conditions – Encore Health

Effective Date: September 20, 2026

These Terms and Conditions (“Terms”) govern your use of https://encorehealthmd.com/ and the online services that link to these Terms (collectively, the “Site”).

The Site is operated by Encore Health Management LLC on behalf of Encore Health and the affiliated professional medical entities that provide clinical services under the Encore Health name (collectively, “Encore Health,” “we,” “us,” or “our”).

1. Acceptance Of Terms

By accessing or using the Site, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Site.

Additional agreements, notices, financial policies, and informed consents may apply to consultations, telehealth, treatment, prescriptions, memberships, purchases, or clinical services. If those terms conflict with these Terms, the more specific agreement controls for the applicable service.

2. Eligibility And Service Availability

You must be at least 18 years old and legally capable of entering into an agreement to use the Site or request services.

Encore Health services are available only in states where we have appropriately licensed clinicians and are legally permitted to operate.

Service availability may depend on:

  • Your physical location at the time of care
  • Clinician licensure
  • Medical appropriateness
  • Clinician judgment
  • Laboratory results
  • Pharmacy availability
  • Applicable laws and regulations

3. Educational Information Only

General information on the Site is provided for informational and educational purposes only.

Site content is not medical advice, diagnosis, treatment, or a substitute for consultation with a qualified healthcare professional who has evaluated you.

Do not start, stop, or change a medication or treatment based solely on information found on the Site.

4. No Emergency Services

Encore Health does not provide emergency services through the Site, email, voicemail, or SMS.

If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department.

Do not delay emergency care while waiting for a response from Encore Health.

5. No Clinician-Patient Relationship Through Website Use

Using the Site, submitting a form, sending a message, or requesting a consultation does not by itself create a clinician-patient relationship.

A clinician-patient relationship begins only after the requirements of the applicable professional medical entity have been completed and a licensed clinician agrees to evaluate or treat you.

6. Telehealth And Clinical Services

Clinical services are provided by licensed clinicians through the applicable affiliated professional medical entity.

You may be required to complete:

  • Identity and location verification
  • Medical history or intake forms
  • Telehealth and treatment consents
  • Laboratory testing
  • A clinical consultation
  • An in-person evaluation when medically or legally required

Clinicians retain independent professional judgment and may decline, modify, or discontinue a requested treatment when medically or legally appropriate.

7. Prescriptions, Laboratories, And Pharmacies

Submitting a consultation request does not guarantee a prescription, test, medication, treatment, or particular outcome.

Prescriptions are issued only when a licensed clinician determines that they are medically appropriate.

Laboratory, pharmacy, compounding, fulfillment, and shipping services may be provided by independent third parties. Product availability, concentration, packaging, appearance, pricing, and delivery timing may vary.

8. Accuracy Of Information

You agree to provide complete, accurate, and current information.

You must not:

  • Impersonate another person
  • Submit information you are not authorized to provide
  • Misrepresent your identity or physical location
  • Provide false or misleading health information
  • Conceal information that could affect the safety of treatment

Incomplete or inaccurate information may delay services and create health and safety risks.

9. Payments, Cancellations, And Refunds

Prices, payment timing, renewals, cancellations, refunds, and shipping terms are disclosed through the applicable checkout, membership agreement, patient agreement, or service-specific terms.

You authorize charges you approve and agree to pay applicable fees.

Nothing in these Terms limits consumer rights that cannot legally be waived.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that mandatory consumer-protection or healthcare laws of your state may also apply.

Disputes involving clinical services may be governed by the separate patient agreement with the professional medical entity providing your care.
